I am pleased to share our recent $400,000 settlement of a slip and fall accident case just prior to trial. My client had been walking to the train station when he fell on a commercial sidewalk covered with ice concealed by a new layer of snow. He had a significant leg fracture that required two surgeries. The insurance company tried to claim that we should sue the City or State because a catch basin in the adjoining street was allegedly clogged and causing the road runoff to back up onto the sidewalk. Depositions revealed that the defendant was well aware of the condition and had directed its personnel to remove the ice and snow but they had failed to do that. My client was diagnosed with a permanent disability as a result of his falldown. Hats off to Hon. Rosemarie Williams (J.S.C. ret.) for her mediation skills.
